WREXHAM MAELOR BOROUGH COUNCIL

CLEAN AIR ACT, 1956

The Borough of Wrexham Maelor (Area No. 4) Smoke Control Order 1976

Notice is hereby given that the Wrexham Maelor Borough Council in exercise of the powers conferred on them by section 11 of the above mentioned Act on the 27th August 1976, made an Order entitled the Borough of Wrexham Maelor (Area No. 4) Smoke Control Order 1976, declaring the area described in the Schedule hereto to be a smoke control area, which Order has been submitted to the Secretary of State for Wales, Welsh Office, Cathays Park, Cardiff, for confirmation.

Subject to the limitations provided by virtue of section 11 (4) of the Act, if on any day after the Order has come into operation smoke is emitted from a chimney of any building within the Smoke Control area the occupier of that building shall be guilty of an offence liable to a fine not exceeding 10 unless he proves that the emission of smoke was not caused by the use of any fuel other than an authorised fuel. The authorised fuels include anthracite coke and other carbonised fuels, gas and electricity.

If confirmed the Order will not come into operation before the 1st September 1977, or before a later date determined by the Secretary of State.

A copy of the Order and the map referred to therein may be inspected free of charge at the Department of Administration and Legal Services, Guildhall, Wrexham, and at the office of the Chief Public Health Inspector, Rhostyllen House, Rhostyllen at all reasonable times during the period of 6 weeks from the 3rd December 1976.

Within the said period any person who will be affected by the Order may by notice in writing to the Secretary of State, Welsh Office, Cathays Park, Cardiff, object to the confirmation of the Order.

SCHEDULE

An area of 5.9 acres or thereabouts of land bounded on its western side by Colliery Road, Wrexham, and by a line extending in a northerly direction from the said road across an area of open land to a point where that land adjoins the Chester/Wolverhampton Railway Line; on its north-eastern side by the said railway line to a point opposite the north-eastern boundary of number 26 Weston Drive, Wrexham; on its southern side by the northern boundaries of number 23 Railway Road and numbers 26 and 35 Weston Drive, Wrexham and the northern side of Weston Drive, Wrexham; on its eastern side by the rear boundaries of numbers 13 to 35 (odd numbers only) Weston Drive, Wrexham ; and on its south-western side by that length of Stansty Road, Wrexham between its junction with Colliery Road, Wrexham and the rear boundary of number 13 Weston Drive, Wrexham.

An area of 36 acres or thereabouts of land bounded on its eastern side by Brynycabanau Road, Wrexham ; on its southern aide by the rear boundaries of numbers 2-22 (even numbers only) Range Road, Wrexham and the Borough of Wrexham (Area No. 7) Smoke Control Order 1972 ; on its western side by the said smoke control Order and the eastern boundary of the Hermitage Drive Estate and the rear boundaries of numbers 14, 15, 16 and 18 Tudor Road, Wrexham, and the eastern boundary of number 115 Norman Road; and on its northern side by the length of Norman Road between numbers 99 and 115 Norman Road and the northern boundary of Ysgol Morgan Llwyd grounds.
